1. Acceptance of Terms

By downloading, installing, or using SMSCode (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

2. Description of Service

SMSCode provides temporary phone numbers for SMS verification purposes. Our service includes:

Temporary phone numbers from various countries
SMS message reception and forwarding
Account management and credit system

3. User Responsibilities

You agree to:

Use the service only for legitimate verification purposes
Not use the service for illegal activities or fraud
Not attempt to circumvent the service's security measures
Respect applicable laws and regulations

4. Prohibited Uses

You may not use SMSCode for:

Creating fake accounts or identity fraud
Spam, harassment, or unwanted communications
Bypassing security measures of other services
Any illegal or harmful activities
Circumventing platform or service age restrictions
Creating multiple accounts to evade bans or restrictions
Engaging in financial fraud, money laundering, or other financial crimes
Activities that violate telecommunications regulations or carrier policies
Using numbers for services that explicitly prohibit virtual number verification

4.1. Carrier and Platform Compliance

Our service operates in compliance with telecommunications carriers and platform policies:

Legitimate Use Only: Numbers are provided solely for legitimate verification purposes
No Commercial Messaging: Our numbers cannot be used to send commercial or promotional SMS
Temporary Nature: All numbers are temporary and messages are automatically deleted
Carrier Compliance: We maintain compliance with all applicable carrier regulations and short code policies
Platform Restrictions: Some platforms may restrict or prohibit the use of virtual numbers for verification
Geographic Limitations: Number availability may vary by region due to local regulations

We reserve the right to restrict access to certain numbers or services if required by carrier policies, regulatory requirements, or platform terms of service. Users are responsible for ensuring their use complies with the terms of service of any third-party platforms they are verifying with.

5. Payment and Credits

Our service operates on a credit-based system using consumable in-app purchases:

Consumable Purchases: Credits are consumable in-app purchases that are used up when you access premium features
Payment Processing: All payments are processed securely through Apple App Store or Google Play Store
Non-Expiring: Credits never expire and remain in your account until consumed
Non-Refundable: Credits are non-refundable except as required by applicable law or store policies
One-Time Purchases: All credit purchases are one-time transactions with no subscriptions or auto-renewals
Restore Purchases: You can restore non-consumed purchases on the same account and platform
Usage Tracking: Credit consumption is tracked for transparency and account management

By purchasing credits, you acknowledge that they are consumable digital goods that will be depleted upon use and cannot be transferred to other accounts or platforms.

6. Account Management and Deletion

You have full control over your account:

Account Access: You can access and review your account information at any time
Data Export: You can request a copy of your personal data
Account Deletion: You can delete your account through the app settings or by contacting support
Data Removal: Account deletion will permanently remove your personal data within 30 days
Credit Forfeiture: Deleting your account will forfeit any remaining unused credits

To delete your account, go to Settings > Account > Delete Account, or contact support@smscode.dev. Account deletion is irreversible and will result in permanent loss of all data and unused credits.

7. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information. By using the App, you consent to our data practices as described in our Privacy Policy.

8. Service Availability

We strive to maintain high service availability but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

8.1. Service Limitations and Platform Compliance

Users acknowledge and understand the following service limitations:

Platform Restrictions: Some platforms (such as WhatsApp, Signal, banking services) may detect and reject virtual numbers
Success Not Guaranteed: We cannot guarantee successful verification with any specific service or platform
Regulatory Changes: Service availability may be affected by changes in telecommunications regulations
Carrier Policies: Number functionality may be limited by carrier policies and network restrictions
No Refunds for Restrictions: Credits are not refunded if a platform rejects or restricts virtual number usage

Important Notice: This service is designed to assist with legitimate account verification needs. However, many platforms are implementing stricter policies against virtual numbers. Users should verify that their intended use is compatible with the target platform's terms of service before purchasing credits.

9. Intellectual Property

The App and its content are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without permission.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

12. Termination

We may terminate or suspend your access to the service at any time for any reason, including violation of these Terms. You may also terminate your account at any time.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or other means. Continued use of the service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the jurisdiction where our company is incorporated, without regard to conflict of law principles.
